WAIVER AND RELEASE OF LIABILITY

Plain Language Disclosure:

By entering Tee Time Social, you acknowledge that you may be seriously injured. Golf balls may be driven at high speeds, and clubs may be swung at full force, both exceeding 100 mph. Balls or tees may ricochet, and entering someone’s swing path could result in serious injury. By acknowledging these risks, you agree that your presence and participation at this facility are 100% at your own risk. You release Tee Time Social and Dog Leg Right Fade LLC from all liability.

RELEASE OF LIABILITY AND ASSUMPTION OF RISK

On behalf of myself, my spouse, children, wards, and their respective successors and assigns, and in consideration of the services and activities provided by Tee Time Social, a DBA of Dog Leg Right Fade LLC, their managers, members, employees, agents, affiliates, volunteers, customers, independent contractors, insurers, and premises owners (collectively, the Released and Indemnified Parties), I hereby agree as follows:

  1. RELEASE AND INDEMNITY
    I, on behalf of the Releasing Parties (myself, my spouse, children, wards, and their respective successors), release, indemnify, and hold harmless the Released and Indemnified Parties from all claims, actions, causes of action, costs, damages, or liabilities, whether known or unknown, arising from any occurrence at Tee Time Social. This includes claims based on negligence or gross negligence.
  2. ACKNOWLEDGEMENT OF RISKS
    I understand golf and related activities involve serious risk of injury or death, even when precautions are taken. Injuries can result from direct impact, ricochets, equipment failure, or misuse. I voluntarily assume all such risks on behalf of myself and the Releasing Parties.
  3. ASSUMPTION OF RISK AND LOSS
    All activities at Tee Time Social are potentially dangerous. I accept full financial responsibility for any injury, damage, or medical care needed by myself or the Releasing Parties, including injury due to preexisting conditions. I understand I am responsible for the safety of personal property.
  4. INJURIES BY OR TO THIRD PARTIES
    I acknowledge that injuries can be caused by others using the facility. I agree to indemnify and hold harmless the Released and Indemnified Parties from any such incidents. Similarly, I agree to defend them against any claim arising from the actions of myself or other Releasing Parties.
  5. INSURANCE
    I certify that I have adequate insurance or financial means to cover all risks of injury or loss incurred by myself or the Releasing Parties, and to indemnify the Released and Indemnified Parties from third-party claims caused by us.
  6. REPRESENTATIONS
    I represent that all participants I am signing on behalf of are physically able to safely participate, and that I have legal authority to sign this agreement for all minors or wards. I further acknowledge this representation is being relied upon by the Released and Indemnified Parties.
  7. BASIS OF BARGAIN
    I understand that without this waiver and release, Tee Time Social would not allow participation in its activities.
  8. CHOICE OF LAW AND VENUE
    This agreement shall be governed by the laws of the State of Wisconsin, and venue shall lie exclusively in Milwaukee County Circuit Court. If the Released and Indemnified Parties incur legal fees enforcing this agreement, I agree to reimburse them.
  9. MODEL RELEASE
    I grant Tee Time Social and Dog Leg Right Fade LLC permission to record and use images, video, and voice likeness for promotional purposes without compensation.
  10. INDEMNITY
    I agree to indemnify the Released and Indemnified Parties from any loss or claim, including legal fees, arising from actions or omissions by myself, my spouse, my children, or my wards while at Tee Time Social.
  11. MISCELLANEOUS
    This agreement is intended to be as broad as permitted under Wisconsin law. Any unenforceable provision shall be severed, and the remainder shall remain in full effect. No verbal or written modifications shall apply unless signed by both parties.
  12. JURY TRIAL WAIVER
    I waive the right to a jury trial in any dispute relating to this agreement. I acknowledge that this waiver is knowingly and voluntarily given to expedite dispute resolution.
  13. GOLFER HANDBOOK AND RULES
    I agree to follow all safety rules and guidelines posted at the facility or published online. These include, but are not limited to:
    • Tee time reservations recommended
    • No metal spikes
    • No food/drink inside simulator bays
    • One person in hitting area at a time
    • Be alert and aware of surroundings
    • Practice and full swings only on hitting mats
    • Report any accidents immediately
    • Respect equipment; users are responsible for damage
    • Surveillance in use; tampering may result in liability
    • Follow all staff instructions
